The terms under which Mahatosoft provides design, development, maintenance and support services.

1. Who these terms apply to
These terms apply between Mahatosoft, a web design and software development studio based in Rajshahi, Bangladesh, and the person or organisation engaging us. Placing an order, approving a scope document or paying a deposit constitutes acceptance.
Where you engage us through a marketplace, that platform's terms also apply, and its terms take precedence in any conflict.
2. Scope of work
Every engagement begins with a written scope: what will be delivered, what is explicitly excluded, the timeline and the price. Work begins only once you have approved it.
Anything not in the scope document is not in the scope. New requirements are welcome, but they are quoted separately and always before we begin them.
3. Your responsibilities
Projects stall for predictable reasons. To keep to the timeline we need from you:
- Content, images and brand assets by the dates agreed in the scope
- Access to hosting, the CMS or the repository where the work requires it
- One named decision-maker who can approve each stage
- Feedback within five working days at each review point
4. Revisions
Revisions inside the agreed scope are unlimited until you are satisfied. A revision is a change to work we delivered; a new feature, an added page or a change of direction is new scope and is quoted.
After delivery, revision requests are covered for seven days as part of free support.
5. Fees and payment
Fixed-price projects are typically invoiced 50% on approval of the scope and 50% on delivery. Projects over eight weeks are milestone-billed. Maintenance plans are billed monthly in advance.
We accept marketplace payments, card, PayPal, Payoneer and selected digital currencies. Invoices are due within seven days unless the scope says otherwise. Work may pause on overdue invoices.
6. Intellectual property
On final payment, all rights in the deliverables transfer to you: the source code, the design files, the repository and the documentation. We keep no licence hook over your business.
Third-party components keep their own licences — a commercial plugin, a stock photograph, a typeface. These are listed in the handover document, and any licence you must hold in your own name is named in the scope.
Unless you ask us not to, we may describe the work in our portfolio in general terms. We never publish client data, credentials or commercially sensitive figures.
7. Support and warranty
Every delivery includes seven days of free support for defects in what we built. A defect is work that does not do what the scope said it would.
This warranty does not cover changes made by others after handover, third-party plugin or platform updates outside our control, or hosting failures. Those are quoted as new work, or covered by a maintenance plan.
8. Liability
We work carefully, take backups before making changes, and test before we deploy. Even so, our total liability for any engagement is limited to the fees you paid for it.
We are not liable for indirect or consequential loss, including lost revenue or lost data where a current backup was available and we advised you to keep one.
9. Cancellation
You may cancel at any time. You pay for work completed to that point and receive it, along with anything needed to continue elsewhere.
We may decline or discontinue an engagement — rarely, and for reasons such as an unworkable brief, non-payment or a request we consider unethical. In that case any unearned payment is returned in full.
10. Governing terms
These terms are governed by the laws of Bangladesh. Before any formal step, both sides agree to attempt resolution directly — in eight years, every disagreement we have had was settled by a phone call.
